1. Acceptance of Terms
By registering for an account or using the Refraxi platform, grading engine, integrations, or services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Refraxi under the laws of Victoria, Australia.
2. Subscription Tiers, Cancellation, & Refunds
We provide Free (Sandbox) access as well as recurring monthly paid subscription plans (Basic, Pro, and Educator). Billing is processed securely through Stripe. Subscriptions automatically renew at the end of each billing cycle. You may cancel your subscription at any time through your dashboard profile settings. Upon cancellation, your subscription will remain active, and you will retain access to your plan's paid features, until the end of your current billing period, at which point the cancellation takes effect and access is downgraded.
Refunds are governed by the Australian Consumer Law (ACL) and the Consumer Affairs Victoria guidelines. Paid subscriptions are generally non-refundable for partial months of service or unused time, except in cases of service failure. If there is a major failure with our service (e.g. prolonged server outage rendering core grading tools unusable), you are entitled to a full refund, replacement, or compensation under your statutory consumer guarantees.
3. Fair Use & AI Generation Limits
Paid tiers offer varied AI generation counts. While the Pro and Educator tiers list "Unlimited AI generations", they are subject to a fair-use policy. We reserve the right to restrict access or temporarily throttle accounts displaying bot-like automation frequencies that degrade performance for other participants.
4. LTI Integrations & Telemetry
Educator subscriptions include Canvas and Blackboard integration privileges. When utilizing LTI 1.3 assignments, Refraxi tracks student performance records, window focusing changes, and elapsed times to maintain test integrity. Instructors are responsible for disclosing classroom telemetry collection procedures to students.
5. Intellectual Property
The layout, software assets, graphics, branding, and proprietary SymPy and CLI terminal simulator designs of Refraxi are protected by Australian and international copyright laws. Users retain ownership of any assessment material they author or upload, but grant us a license to process and format that content for platform rendering.
6. Governing Law
These terms are governed by and construed in accordance with the laws of Victoria, Australia. Any dispute arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
